At the core of MKB Lawyers’ mission is helping people. Over the years, we have found that despite many clients wanting their “day in court,” what most clients really need is a practical solution to their legal problem. Despite being trial lawyers by trade, MKB Lawyers are also counselors by nature. We often recommend ADR - Alternate Dispute Resolution - to our clients in all of different types of cases we handle. Mediation is usually voluntary, and is a process in which the involved parties use a trained mediator to attempt to find a compromise solution. Mediation can be best, as it allows both sides to control the outcome of their dispute, since both sides must agree to settle a case in mediation. Arbitration can be more adversarial, as a trained arbitrator (or panel of arbitrators) acts as both judge and jury in what is essentially a “mini-trial.” Arbitration is generally less expensive than a jury trial, but still allows a party to have their case heard. Both approaches can save time, money, and ultimately STRESS for our clients. Saving our clients from stress is the MKB Lawyers’ super power. Lowell McKelvey is regularly asked by both plaintiffs’ and defense lawyers to sit as a panel arbitrator on Uninsured and Underinsured Motorist (“UIM”) cases. He therefore knows arbitration from all sides - the plaintiff’s, the defense’s, and the arbitrator’s.
